Charges in 2026 Criminal Trial

Oslo State Attorneys brought 38 charges against Marius Borg Hoiby as part of 2026 Criminal Trial. The sentences for these charges range from a fine to 10 years in prison.
Marius pleaded :

  • Guilty – 8 counts
  • Partial Guilty – 5 counts
  • Not Guilty – 15 counts

The charges against Marius are listed below.

Plead Guilty (18 counts)

  • 1x Sexually offensive filming/photography
    • On December 2, 2023, he took a picture of the Frogner woman1‘s vagina while performing a sexual act. She was not aware that she was being photographed, and had not consented to this.
  • 1x Aggravated drug trafficking for having acquired, stored and delivered drugs.
    • On July 23, 2020 in Lørenskog, he received at least 3.5 kg of marijuana, which he transported to Tønsberg and handed over to one person.
  • 2x Reckless behavior
    • On August 4, 2024, he repeatedly shouted at the Frogner woman, called her names and made serious accusations against her.
    • From August 24 to September 1, 2024, he contacted the Frogner woman repeatedly with at least 172 calls and messages.
  • 1x Threats
    • On August 4, 2024, he sent an Instagram message to a man in his 20s that he was a “fucking dead man,” and told the Frogner woman that he was going to kill the man.
  • 2x Driving without a driver’s license
    • On November 10, 2024, he drove a car in Asker despite not having a valid driver’s license.
    • On November 18, 2024, he drove a car in Asker despite not having a valid driver’s license.
  • 5x Reckless driving
    • On March 31, 2023, he drove 88 km/h in a 50 km/h zone.
    • On May 6, 2023, he drove 80 km/h in a 40 zone.
    • On May 13, 2025, he was driving a motorcycle at 100 km/h in an 80 zone.
    • On May 29, 2025, he drove a motorcycle at 74 km/h in a 40 zone, and at 91 km/h in a 60 zone.
    • On August 14, 2025, he was driving a motorcycle at 117 km/h in an 80 zone.
  • 2x Malicious damage
    • On February 24, 2024, he hacked the Frogner woman’s PC.
    • On August 4, 2024, he broke the Frogner woman’s mirror, chandelier, headphones, and telephone.
  • 3x Violation of the no-contact order
    • From October 29 to November 18, 2024, he had constant contact with the Frogner woman despite not being allowed to contact her.
    • From October 24 to November 23, 2025, he had regular contact with the Frogner woman despite the fact that he was not allowed to do so due to the contact ban.
    • From November 28 to December 16, 2025, he had regular contact with the Frogner woman despite the fact that he was not allowed to do so due to the contact ban.
  • 1x Unlawful behavior towards the police
    • On January 30, 2025, he gave the finger at two police officers.

Partially plead guilty (5 counts)

  • 1x Serious bodily harm
    • On August 4, 2024, he repeatedly choked the Frogner woman so that she could not breathe, hit her in the face with the flat of his hand and held her down on a bed.
  • 3x Reckless behavior
    • On March 24, 2024, Høiby punched a glass door and then punched another door. He screamed and gesticulated at the Frogner woman, knocked over furniture and tore off his T-shirt.
    • On June 25, 2024, he screamed in the Frogner woman’s face, called her names and threw things around the apartment.
    • On November 13, 2024, he screamed at the Frogner woman, hit the dashboard of a car hard and dragged her out of the car.
  • 1x Reckless driving
    • On October 26, 2023, he drove at 73 km/h in a 40 zone on a narrow road on the way to Skaugum and filmed the driving. The driving posed a danger to guards at the scene.

Plead Not Guilty (15 Counts)

  • 1x Rape with intercourse.
    • On October 8, 2023, he had sexual intercourse with a woman he met in Lofoten, despite her being unable to resist the act. The act of rape includes intercourse.
  • 3x Rape without intercourse (I.e. Sexually assaulting an incapacitated person)
    • On December 20, 2018, he sexually assaulted a woman in her 40s.
    • On March 24, 2024, he sexually assaulted a woman he met at a party in Oslo.
    • On November 2, 2024, he sexually assaulted a woman he was with at a hotel in Oslo
  • 5x Sexually offensive filming/photography (I.e. filming a person’s genitalia without their permission or knowledge)
    • On October 8, 2023, he filmed the vagina of a woman he met in Lofoten.
    • Between November 21 and 22, 2023, he took pictures of the Frogner woman’s genitals and filmed sexual acts. 
    • On March 24, 2024, he filmed the woman in her 20s, whom he met at a party in Oslo, while they were having sexual intercourse and while he was carrying out the rape listed above.
    • On November 2, 2024, he took photos and video of the vagina of a woman in her 20s, with whom he was with at a hotel in Oslo, while they were having sexual intercourse, and while he carried out the rape listed above.
  • 1x Abuse in close relationships
    • In the period from the summer of 2022 to the fall of 2023, he abused his then-roommate Nora Haukland 2 through repeated violence, threatening behavior and other abuses. He hit, kicked, choked, threw things at her and used abusive language. He also checked where Haukland was, who she was with and pressured her to give up work assignments.
  • 1x Physical abuse
    • On June 25, 2024, he spat in the Frogner woman’s face before hitting her with the flat of his hand.
  • 3x Violation of the no-contact order
    • On September 7, 2024, he called the Frogner woman from an unlisted number despite not being allowed to contact her.
    • On September 21, 2024, he called a friend of the Frogner woman with threats to reach her despite the fact that he was not allowed to contact her.
    • On December 8, 2024, he sent a message to the Frogner woman via the encrypted messaging service Signal asking “can we talk?” despite the fact that he was not allowed to contact her.
  • 1x Unlawful behavior towards the police
    • On January 30, 2025, he refused to provide his personal information to the police when he was checked.

The criminal case included some (but, not all) of the charges brought by the Oslo Police in June 2024. It also includes additional charges committed after the investigation concluded.


Possible Sentence:

In Norway, the sentences for each charges does not get added to each other. Instead, the court takes the sentence of the most serious offense and can add up to 6 additional years. The most serious charges against Marius have a sentence of up to 10 years.

So, the maximum sentence Marius could be given is 16 years. (10 years for most serious crime + 6 additional years= 16 years).

    • Arrested after repeatedly violating restraining order.

    • Released the same day

Earlier Arrests

July 2017

  • Marius is arrested for cocaine at the Palmesus music festival. 
  • He was fined 4,000 kroner.
